NOTICE OF PUBLIC SESSION OF SCHEDULE PETITION

NOTICE IS HEREBY GIVEN that pursuant to NMSA 1978, § 3-7-14(B) (1965), the Municipal Boundary Commission (“Commission”) will hold a public meeting on Friday, May 27, 2022, beginning at 1:00 p.m. in the Municipal Court Chamber located at 16B East Cordova Avenue, Cuba, New Mexico, to consider the petition for the annexation of unincorporated territory in Sandoval County, State of New Mexico, to the village of Cuba, State of New Mexico. Mexico (“Petition for annexation”).

APPROXIMATE LOCATION: North of Cuba Village along the west side of US Highway 550

The Mayor and Clerk of the Village of Cuba, a municipality incorporated under the law of New Mexico, pursuant to the boundary commission method provided for in NMSA 1978, § 3-7-11 (1995) through NMSA 1978, § 3-7-16 (1983), requested the Commission to annex to the village of Cuba the unincorporated territory described below and located in Sandoval County, New Mexico:

UNINCORPORATED TERRITORY REQUESTED TO BE
ANNEX TO THE VILLAGE OF CUBA

The northeast quarter of the northeast quarter of section 19, the northwest quarter and the northwest quarter of the northeast quarter of section 20, T.21N., R.1W., NMPM (Forest Service Land);
Part of Lot 2, Section 20, T.21N., Rl W., NMPM, being Lots 1 to 7, inclusive, of the lands of Rafael and Audelia Duran, filed 2008-11-26, vol. 3 Folio 2980-A;
That portion of Small Grant No. 3241, Area 2, (assigned to Noberto Garcia) falling west of U.S. Highway No. 550, comprising Lots A through E, inclusive, of the lands of Theresa Duran, filed 1986-01-15, Vol.3 Folio 566-B and all Meeks supplements, filed 1971-09-27, Vol. DR9, sheet 473;
All of Small Concession No. 3249 outside the existing boundaries of the village of Cuba, including:
Lands of Cuba Credit Union as indicated on the plate filed on 08/15/2012, vol. 3, sheet 3482. and
A previously excluded portion of Lot 3, Abstract Subdivision Plat, Lands of Andres & Carolina Maestas, filed 2016-06-22, Vol. 3, sheet 3977, and
A previously excluded portion of Small Holding Claim No. 3241, Tr. 1, (assigned to Juan Jose Salazar), being part of Lot 1, Lands of AGL Enterprises, filed 6/7/2011, Vol. 3, Folio 2815-B.
All in sections 20 and 29, T.21N., R.lW., NMPM, and containing 317 [a]cres, more or less.
The Village of Cuba stated the following in support of its annexation request:
1. It is desirable and necessary to provide clean water using an efficient and environmentally friendly ion exchange process.
2. It is desirable and necessary that the measures described above [unincorporated] territory be annexed to the Village of Cuba.
3. A community of interests exists between the [unincorporated] territory proposed for annexation and the Village of Cuba.
4.The [unincorporated] territory proposed to be annexed is integrated or is likely to be integrated into the Village of Cuba.
5. No annexation proceedings have been initiated by any other municipality for the annexation of part or all of the area proposed to be annexed to the Village of Cuba.
6. Annexation of the [unincorporated] the territory proposed for annexation will not result in the detachment of the area from a school district [or] its attachment to another school district.

In accordance with New Mexico law, the Secretary to the Commission will post a Notice of Public Hearing on the Annexation Petition once a week for four (4) consecutive weeks and the last posting will be at least twenty (20) days before the date of the public hearing.
